Miller repeated-litigation chronology
Federal case C041 was dismissed with prejudice in Dec. 2024 on grounds the adopted R&R described as frivolous, meritless, and involving jurisdictional manipulation, while a parallel Lackawanna County state case (C001) against the same core defendant continued to be actively litigated and later gained the same additional defendants named in C041. A third federal case (C081), naming the identical defendant caption, was filed in July 2026.
The adopted C041 R&R's own language ("legally infirm," "without merit," "frivolous claims," "jurisdictional manipulation"), combined with direct review of C001's Verified Complaint independently confirming all four additional defendants match C041's caption.
Research assessment
The pattern of continued/renewed litigation against the same core defendant after a frivolous/meritless with-prejudice dismissal is well-documented for C001 and C041. C081 is confirmed only by its docket filing and defendant list; its own claims and status have not yet been independently researched.
Important caveat
C081 remains Research pending — do not describe it as raising identical claims to C041 without a direct complaint comparison. C001 has no disposition of its own; it is not closed, and no court has found its claims frivolous or meritless.

Source — ic-access.com ↗District court adopted Magistrate Judge Carlson's R&R in its entirety and dismissed C041's amended complaint with prejudice; the adopted R&R had described the case as legally infirm, without merit, involving frivolous claims and jurisdictional manipulation.
Source — pacermonitor.com ↗Tufano filed C081 in M.D. Pa. against the identical seven-defendant caption named in the dismissed C041, roughly 19 months after C041 was dismissed with prejudice on frivolous/meritless grounds. C081 itself remains Research pending beyond the confirmed filing and defendant list.
